How Important is a Work Permit When Working in the U.S. as an Immigrant?

Living and working in the United States is a dream that a lot of immigrants want to fulfill. But immigrants can only work legally in the country if they have a work permit. The USCIS issues work permits to qualified individuals and those who meet the requirements. A work permit, which is also called an Employment Authorization Document (EAD), is meant for American employers to make sure their employees are authorized to legally work in the country. So, if you want to work in the U.S. as a foreigner, you must prepare up-to-date and legalized documents. An immigration attorney can give you legal advice and guidance when preparing these documents.

A work permit applicant does not have to be a permanent U.S. resident. However, they must possess an immigrant or non-immigrant visa that lets them live and work in the country.

    Work Permit vs Work Visa

A lot of people mistake work permits for work visas. A work visa lets you stay in the United States and work for a certain employer. This employer applies for a visa on your behalf. This visa is valid for as long as you work for this employer. Also, when you leave this employer, you cannot work for others until you obtain another immigration status.

Meanwhile, a work permit isn’t tied to a certain employer. After you obtain this permit, you can work for any U.S. employer. You can renew your work permit if your immigration status lets you continue to work. It is important to check the expiration date of your work permit, so you can renew it and provide the USCIS with enough time to process your application.

What to Expect if You Work in the United States Without a Work Permit

It is dangerous to work in the country without a work permit. You can get deported. Also, you can be barred from entering the country for up to ten years. You may have difficulty getting temporary or permanent status.

A work permit is required even for under-the-table or short-term employment. In fact, working without a permit if you get paid just for a few hours of work can lead to severe immigration issues for you over time. Thus, you should not try to work in the U.S. without a work permit, regardless of the nature of the work. After all, it is easy to apply for this permit. Also, submitting a green card application at the same time is free.
